Below are our standard terms and conditions that are applied to all our track days and events. You will be asked to confirm that you have read and agreed to these whenever you hire a vehicle or book an event.
The Hirer represents and warrants to Eau Rouge Car Club Ltd that he has sufficient skill and experience to operate and control the vehicle and that he will at all times comply with the safety rules (and all other rules whether they be those of Eau Rouge Car Club Ltd, the Track Day Operator or its marshals, the Track Owner and/or the Track Day organiser). If Eau Rouge Car Club Ltd’s insurance policy is invalidated or an insurance claim is rejected because the Hirer has failed to disclose a relevant fact to Eau Rouge Car Club Ltd it will hold the Hirer solely responsible for any losses, damages or other economic effect suffered by it and the Hirer agrees to indemnify Eau Rouge Car Club Ltd against any losses suffered by it as a result of the Hirer’s failure so to disclose. The Hirer will forthwith upon the signing of this Agreement provide the Hirer’s Credit Card details to Eau Rouge Car Club Ltd. The Hirer hereby authorizes Eau Rouge Car Club Ltd to charge any amounts properly due to it from the Hirer either to the Hirer’s Credit Card and if Eau Rouge Car Club Ltd is unable to take payment of such amount for whatever reason, the Hirer undertakes to pay such amount on demand to Eau Rouge Car Club Ltd.
1.1 The Hirer must not deliberately abuse the Vehicle or its tyres, brakes, suspension or other components. Examples of abuse include (but are not limited to) excessive wheel spinning, doughnuts, handbrake turns or any other activity not in keeping with normal track or road driving activity. The Hirer must not cause the Vehicle engine speed (rpm) to exceed the maximum engine speed for the vehicle and they should change gear in accordance with Eau Rouge Car Club Ltd instructions or the shift lights on the vehicle, failure to use the gearbox properly causing the engine to exceed it’s maximum operating speed as indicated by the on board rpm recall device to the extent that the engine suffers damage due to the Hirer’s breach of these requirements then the mechanical damage excess of £3,500 will apply. The Hirer must not interfere with any of the data logging equipment on board the vehicle.
1.2 In addition to its rights under clause 1 and 1.1 if the Vehicle suffers any damage however caused whilst rented to the Hirer, the Hirer shall pay Eau Rouge Car Club Ltd’s insurance excess of £3,500. Any damage will be repaired at an Eau Rouge Car Club Ltd approved repair centre. In the event of an accident the excess liability is always with the driver regardless of who is considered at fault in the event of an accident. In the event of any incident that effectively makes the car unusable including a spin or incident on track no refund will be given. However, in the event of mechanical breakdown through no fault of the driver, alternative cars, a pro-rata refund or a new date & venue can be arranged. Where fault is disputed in this instance, the opinion of an agreed independent assessor will be taken as final as to where the fault lies.
1.3 Eau Rouge Car Club Ltd reserves the right to refuse access to the cars to any person not deemed safe to drive, or behaving in a competitive or aggressive manner or if it believes the hirer is driving inappropriately on the track. If the Hirer spins the vehicle they must return to the pits immediately for the vehicle to be checked before being allowed back on to the circuit, no additional time will be added on to account for this check. If the Hirer spins on a second occasion the must return to the pits immediately and their session will be ended. If the hirer’s session or day is ended by the track day operator or track marshals no refunds will given. Car use is limited to a maximum of 30 minutes per hour of driving time available
1.4 The Hirer must place safety as his first priority and must comply in all respects with any requirements of the Track Owner or the Track Day Operator. The Hirer must immediately stop driving the Vehicle or if possible negotiate it safely back to the pit lane if he believes that there are any unusual handling characteristics that would indicate a fault or if he believes that there is something wrong with the Vehicle. The Hirer must stop driving the Vehicle or if possible negotiate it safely back to the pit lane if any warning lights appear on the dashboard or instrument display. On a Track Day the Hirer is solely responsible for any damage caused to the track and liable for any and all damages caused to any other vehicles as a result of his actions.
1.5 The Hirer will indemnify Eau Rouge Car Club Ltd and keep it indemnified in respect of any loss, claim, liability, damage or expense incurred by it as a result of the Member’s failure to observe any of the Rental Conditions or any other provisions of this Agreement.
1.6 If the credit card pre-authorisation is supplied by a 3rd party, ie not the hirer then Eau Rouge Car Club Ltd Car Club Ltd reserves the right to insist upon an Eau Rouge Car Club Ltd approved instructor to be present for the duration of that client’s hire period.
